12/02/2004: Appeal against airports PPP decision rejected
Alterra Consortium, for whom Andreas Neocleous & Co acted, was chosen in November 2003 as the preferred bidder for the CY£200 million (US$404 million) Public-Private Partnership (PPP) contracts to upgrade the airports at Larnaca and Paphos, following a unanimous decision by the Cypriot governments Central Tenders Board. A representative member of a loosing consortium has now failed to overturn this decision. Andreas Neocleous & Co was retained by the Alterra Consortium to represent it as an interested party throughout.

It is with great pleasure that Andreas Neocleous & Co announced the election of two leading lawyers to the partnership of the firm, with effect from 1 January 2004.

Kyriacos Georgiades specialises in banking and general corporate work. Chambers Global 2003-2004 said that Kyriakos had ‘…received numerous recommendations from clients and foreign law firms...’, and had been ‘…singled out as a prominent member of the team.’ He graduated from Queen Mary College, University of London, in 1978 and was admitted as a Solicitor of the Supreme Court of England and Wales in 1980. He was previously a partner in the London law firm, Mundays.

Anna Panayiotidou is Head of Team Two in the Litigation Department which deals with banking and finance disputes, hire purchase agreements, bankruptcy and insolvency law as well as Matrimonial matters. She specialises in Family and Divorce Law, Banking Law and Insolvency Law. She graduated from Salonica University in 1992 and was admitted to the Cyprus Bar Association in 1993.

Cообщает ведущее еженедельное издание деловых кругов острова Файнэншнл Миррор в своем выпуске от 31 декабря 2003 года. Газета анализирует, каким образом новое положение острова повлияет на торговые и экономические взаимоотношения со странами, не входящими в Европейское сообщество, но играющими значительную роль в кипрской экономике. Кроме соглашений об избежании двойного налогообложения, действие которых сохранится и после присоединения Кипра к Европейскому Союзу, одной из фундаментальных основ взаимоотношений представляется экономически выгодный и надежный торговый арбитраж на Кипре. В качестве другого ключевого аспекта упоминаются преимущества, связанные с кипрскими холдинговыми компаниями, паевыми инвестиционными фондами и трастами, а также с судовладением и судоходными услугами. При том, что налоговый фон вынужден был претерпеть изменения, в отказе от оффшорного статуса Кипра, полагают авторы, нет никакой необходимости. В целом, по мнению специалистов, Кипр сохранит свой статус благоприятного региона для российских интересов.

КИПР ВСТУПАЕТ В ЕС
На саммите ЕС, проходившем в Копенгагене 12/13 декабря, решение по вступлению Кипра в ЕС было в целом одобрено. В зависимости от референдума по ратифицированию соглашения, вступление должно произойти 1 мая 2004 года.
Процесс вступления Кипра в Европу начался в 1972 году, когда было подписано Соглашение Объединения между Кипром и ЕС, в отношении отмены таможенных пошлин и иных ограничений. Переговоры об объединении официально начались в 1998 году, и с тех пор Кипр был вовлечен в приведение своего законодательства в соответствие с правом Европейского Союза, в частности с Европейским Кодексом Поведения по Налогообложению Бизнеса.
В качестве примера, основные изменения в кипрской налоговой системе, которые вступают в силу 1 января 2003 года, свидетельствует о том, что Кипр решительно настроен занять соответствующее место в ЕС.

02/12/2002: SEMINARS IN RUSSIA
At the State Duma

Cyprus is ready to join the European Union. To do so, it has been necessary to effect radical changes in its laws, especially its tax laws, in order to comply with the acquis communautaire of the EU in general and with the EU Code of Business Taxation in particular. Cyprus will eventually join the Schengen treaty, which has a single visa for non-Schengen countries.

In view of the above, certain competitors of Cyprus procured adverse publications in the international media, especially in Eastern European countries and Russia. Some Russian authorities and members of the business community began to worry about the situation because they use Cyprus as a business basis amongst others and are seeking some clarifications and information regarding the new developments.

In this context, our Managing Partner, Mr. Andreas Neocleous, was invited by the Russian Parliament (State Duma) to lecture to two of its Committees, the Committee Responsible for the Financial Institutions and the Financial Markets and the Legislative Committee, on 18th November 2002.

Mr. Neocleous, assisted by Olga Mikhailova, one of our Russian lawyers, explained to the Russian legislators that the accession of Cyprus to the European Union will not have an adverse effect on Russian-Cypriot economic relations but, on the contrary, will further enhance them. Morever, the new tax changes in Cyprus will turn Cyprus into the door to the European Union for Russian and Eastern Europe businesses.

The meeting at the Duma was presided over by the Chairman and the Vice-Chairman of the respective Committees, Mr. Zubov and Mr. Vorotnikov. It was attended by 50 and more members of Duma, also by the Cypriot Ambassador, Mr. A. Georgiades, and by the media.

The seminar lasted for two hours. It included lively question and answer sessions which provided opportunities for clarifications of numerous matters.

At the Moscow Chamber of Commerce and Industry and the Moscow Bar Association

On the following day, 19th November 2002, Mr. Neocleous lectured to members of the Moscow Chamber of Commerce and Industry and the Moscow Bar Association.

Assisted again by Olga Mikhailova, he spoke about the recent tax changes in Cyprus and the effect of the accession of Cyprus to the EU. His speech, entitled ‘The effect on Cypriot-Russian relations of the accession of Cyprus to the European Union, was also circulated with other papers; to read the speech, please CLICK.

Mr. Kasumov, the Vice-President of the Chamber of Commerce and Industry was the host and the event was attended by more than 70 persons including lawyers, business people, professors and representatives of Cypriot and foreign banks.

The Cypriot Ambassador was present as well as the Cypriot Commercial Attache Mr. Aris Georgiou.

After the seminar Mr. Neocleous, the Ambassador and the Commercial Attache answered questions.

When it becomes a member of the EU, it will have the lowest rate of corporation tax of all member states.
